SPECIAL MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF

KENILWORTH� HELD ON WEDNESDAY, AUGUST 3, 2005.� MAYOR GREGG DAVID PRESIDED.

Roll Call at 7:00 P.M. showed the following Council Members present:�� Carmela Colosimo, Alan Jankunas, Fred Soos, and Robert Taylor.� Peter Corvelli and Ed Galasso were absent.

Mayor David read the requirements of the Open Public Meetings Act.

The Salute to the Flag was led by Mayor David.

ORDINANCES & RESOLUTIONS

Proposed Ordinance No. 2005-11 was read for second and final reading as follows: (Copy appears����

A BOND ORDINANCE AUTHORIZING VARIOUS ROAD IMPROVEMENTS IN, BY AND FOR THE BOROUGH OF KENILWORTH, IN THE COUNTY OF UNION, NEW JERSEY APPROPRIATING AN AGGREGATE AMOUNT OF $770,100 THEREFOR AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $598,595 IN AGGREGATE PRINCIPLE AMOUNT OF BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF.

Mayor David stated this Ordinance funds this years capital road improvements.

Mayor David opened the meeting to the public.

Mr. Fisher, Commonwealth Road, complained that the dry wells on Commonwealth serve no purpose and that several houses were not done when the street was originally improved.

Councilman Soos stated that streets were done in sections however they are now constructing the entire street.

Mr. Ford, Commonwealth Road, stated that he did not want new curbing.

Mr. Niver, North 22nd Street, asked if all curbing will be removed and if he could keep the curbs he installed.

Councilman Soos stated that the curbs would be removed if not in line with the new curbs.

Mayor David mentioned he can keep his belgium blocks.

Mr. Redco, North 22nd Street, asked for more information including time frame, payment schedules, etc.

Councilman Soos mentioned the payment is due within 5 years, they try not to remove trees, the roads will be 20 foot wide and the project should be complete by November.

Mr. Plumber, North 22nd Street, asked if the water lines would be checked.

Mayor David stated that the utility companies were notified and they will follow up with them.

Mr. Costa, North 22nd Street, asked if the barricades were staying up.

Councilman Soos said the barricades will stay up.

Introduced by Taylor who also moved its adoption.

AN ASSESSMENT BOND ORDINANCE AUTHORIZING LOCAL IMPROVEMENTS CONSISTING OF THE CONSTRUCTION OF 640 LINEAR FEET OF NEW CURBS ALONG NORTH 15TH STREET FROM NORTH 14TH STREET TO LAFAYETTE AVENUE, 310 LINEAR FEET OF NEW CURBS ALONG COMMONWEALTH ROAD FROM PARK DRIVE TO NEW CONSTRUCTION LIMIT, 1,040 LINEAR FEET OF NEW CURBS ALONG NORTH 22ND STREET FROM OAK STREET TO MONROE AVENUE AND 420 LINEAR FEET OF NEW CURBS ALONG PEMBROOK DRIVE FROM SHERWOOD ROAD TO NEW CONSTRUCTION LIMIT, IN BY AND FOR THE BOROUGH OF KENILWORTH, IN THE COUNTY OF UNION, NEW JERSEY, APPROPRIATING AN AGGREGATE AMOUNT OF $91,200 THEREFOR AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $86,640 IN AGGREGATE PRINCIPAL AMOUNT OF BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF AND DIRECTING A SPECIAL ASSESSMENT OF THE COST THEREOF.

Mayor David explained that this Ordinance is for curb assessments for the streets being reconstructed.

Mayor David opened the meeting to the public.

Mr. Ladoto, North 15th Street, asked if they had to have curbs installed.� Mr. Ladoto stated it wasn�t fair that some streets don�t have to pay for curbs and others do.

Mayor David said curb installation is a town policy.

Councilwoman Colosimo stated that the Borough tries to get as many grants as possible.

Mr. Plumber, North 22nd Street, asked how grants were decided.

Mayor David explained that the Borough is no longer eligible for grants other than DOT grants.

Community Development grants are based on income and due to the last census we no longer qualify.�

Mr. Fisher, Commonwealth Road, asked Council not to rush into anything.

Mr. Antonuccio, North 15th Street, asked if he could install his own curbs.

Councilman Soos answered no.

Mr. Redco, North 22nd Street, asked if the paving is also assessed.

Mayor David stated no.

Mr. Davey, Pembrook Drive, asked for a time frame.

Councilman Soos, stated work will begin in September and should be complete by November.

Mr. Costa, North 22nd Street, asked if those who installed curbs will be reimbursed.

Councilwoman Colosimo stated if you installed curbs you can keep your belgium blocks.

Mr. Ford, Commonwealth Road, asked if enough people opposed the curbing can they just do the road.

Mayor David stated curbing is a town policy.

A BOND ORDINANCE AUTHORIZING THE PERFORMANCE OF A STUDY FOR THE PURPOSE OF CONDUCTING A SANITARY SEWER CAPITAL MAINTENANCE PROGRAM IN, BY AND FOR THE BOROUGH OF KENILWORTH, IN THE COUNTY OF UNION, NEW JERSEY, APPROPRIATING AN AGGREGATE AMOUNT OF $53,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $50,350 IN AGGREGATE PRINCIPAL AMOUNT OF BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF.

A BOND ORDINANCE AUTHORIZING STORM DRAINAGE IMPROVEMENTS TO VARIOUS STREETS IN, BY AND FOR THE BOROUGH OF KENILWORTH, IN THE COUNTY OF UNION, NEW JERSEY, APPROPRIATING AN AGGREGATE AMOUNT OF $80,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $76,000 IN AGGREGATE PRINCIPAL AMOUNT OF BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF.

RESOLUTION NO. 4

Be It Hereby Resolved:�� That Proposed Ordinance No. 2005-14, be and the same is hereby passed on second and final reading and ordered published according to law.

Seconded by Soos and on roll call unanimously carried.

RESOLUTION NO. 5

Introduced by Soos who also moved its adoption.

Be It Hereby Resolved:�� That PETER P. SEPELYA, JR. be employed as a consultant for the Finance Department retroactive to July 27, 2005 for not to exceed five (5) hours per week at a rate of $60 per hour.

Seconded by Jankunas and on roll call unanimously carried.

RESOLUTION NO. 6

Introduced by Jankunas who also moved its adoption.

Be It Hereby Resolved:�� That RONALD S. FRIEDMAN be employed as a Driver/Laborer in the Department of Public Works at a rate of $12.00 per hour effective as of August 8, 2005.

Seconded by Taylor and on roll call unanimously carried.

GENERAL BUSINESS

Councilman Jankunas stated that the actual assessments are not immediately processed.

ADJOURNMENT

There being no further business to come before the Council, it was moved by Soos, seconded by Colosimo and carried, that the meeting be adjourned to the call of the chair.
